Beware the sensitive nose of the law
An American drink driver has been charged with battery on a police officer after passing wind and wafting it in the cop’s direction. Jose A. Cruz, aged 34, of West Virginia,  was initially pulled over early on Tuesday for driving without headlights. The policeman smelt alcohol on Cruz and the driver then failed three roadside sobriety tests.
Cruz was taken to a nearby police station to carry out a breathalyzer test. As the policeman prepared the test, Cruz slid his chair across the room, lifted his leg and let rip towards the officer. “The gas was very odorous and created contact of an insulting or provoking nature with Patrolman Parsons,” the criminal complaint alleged. It also claimed that Cruz fanned the odour towards the officer.
“I couldn’t hold it no more,” Cruz told the court in his defence. He claimed he had an upset stomach at the time and police officers had refused his requests to go to the toilet.
